PAGE\*MERGEFORMAT5论个人信息的行政法保护摘要个人信息是人类社会长期发展的产物，对个人信息的保护程度是一个国家和地区民主法治建设成就的重要标志。随着现代网络信息技术的高速发展，个人信息网络化的程度日益加深，我国个人信息滥用的问题日趋严重，行政机关非法侵害个人信息现象层出不穷。社会对个人信息保护立法的需求越来越迫切，从行政法的角度对个人信息进行保护已成为必然的发展趋势。然而在个人信息的行政法保护这个问题上，我国的学术界和理论界的理论研究较为落后，也没有专门对个人信息进行立法保护。本文拟从个人信息的概念界定出发，阐释个人信息的基本特征，分析个人信息行政法保护的理论基础，揭示我国个人信息行政法保护的立法概况以及存在的主要问题，并在此基础上提出完善个人信息行政法保护的建议，力求推动中国对个人信息保护的立法进程。关键词：个人信息；行政法；保护；完善；OntheProtectionofpersonalInformationinAdministrativeLawAbstractPersonalinformationistheproductofsocialdevelopment,andthedevelopmentdegreeofpersonalinformationprotectionisanimportantsymbolofacountry'sachievementsintheconstructionofdemocracyandruleoflaw.Withtherapiddevelopmentofnetworkinformationtechnology,thedegreeofpersonalinformationnetworkingisdeepening,thetransparencyofinformationisgettinghigherandhigher,especiallywiththepopularizationofinformationprocessingandstoragetechnology,theproblemofpersonalinformationabuseisbecomingmoreandmoreseriousinourcountry.Therearenumerouscasesofinfringementandabuseofpersonalinformationbygovernmentandotherpublicorgansintheprocessofexercisingadministrativefunctions.Thesocialdemandforpersonalinformationprotectionlegislationismoreandmoreurgent.Preventingtheinfringementofpublicpoweronpersonalinformationhasbecomethefocusoflegislation,fromtheangleofadministrativelaw.Degreeofpersonalinformationprotectionhasbecomeinevitable.However,thetheoreticalresearchandlegislativeprotectionofourcountryarerelativelybackwardonthisissue.Therefore,ourcountrymustspeeduptheprotectionofadministrativelawofpersonalinformationandpreventtheinfringementofpublicpoweronpersonalinformation.Thispaperanalyzesanddemonstratesthedefinitionofthebasicproblemsofpersonalinformation,thebasicprincipleofpersonalinformationadministrativelawprotectioninourcountry,andthedefectsexistingintheprotectionofpersonalinformationadministrativelawinourcountry.Onthisbasis,theauthorputsforwardsomesuggestionsonhowtoconstructtheprotectionsystemofadministrativelegislationinordertopromotet
